Please read these terms carefully. By accessing or using Auction Eagle you agree to be bound by them.
1. About these terms
These terms and conditions (“Terms”) govern your use of the Auction Eagle website at auctioneagle.co.uk and any related services (together, the “Service”). The Service is operated by SmoothByte IT (“Auction Eagle”, “we”, “us” or “our”). By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
2. What Auction Eagle is (and is not)
Auction Eagle is an auction-discovery directory. We help you find upcoming and past auctions and lots held by auction houses across the United Kingdom, and we link you through to the relevant auction house or bidding platform (such as BidSpirit).
We are not an auctioneer. We do not run auctions, sell or value any lot, take bids, hold stock, process payments, or arrange delivery. Any auction, sale, bid or purchase is conducted by, and is a matter solely between you and, the relevant auction house on its own platform, subject to that auction house’s and platform’s terms.
3. Listing information
Listings, catalogues, lot details, images, estimates, dates and locations shown on the Service are provided by, or aggregated from, participating auction houses and public sources, and are made available for general information only. We do not verify, and do not warrant the accuracy, completeness or currency of, any listing. Details can change or be withdrawn at any time. Always confirm the details of any auction or lot directly with the auction house or on its bidding platform before relying on them or placing a bid.
4. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract to use the Service. Auction houses and their representatives must be authorised to act for the house they register or claim.
5. Your account
Some features require an account. You agree to provide accurate information, to keep your login details confidential, and to be responsible for activity under your account. Please tell us promptly if you suspect any unauthorised use. We may suspend or close accounts that breach these Terms.
6. Auction-house accounts and claims
If you register or claim an auction house, you confirm that you are authorised to do so and that the information you provide is accurate and not misleading. We may review, verify, approve, reject or remove any auction-house registration, claim or listing at our discretion. You are responsible for the content you add, and you grant us a non-exclusive, royalty-free licence to display it on the Service.
7. Free to use; future paid features
The Service is currently free to use. We may introduce paid or premium features in the future. If we do, we will make the terms clear before you incur any charge, and you will not be charged without your agreement.
8. Acceptable use
You agree not to:
- use the Service unlawfully or fraudulently;
- copy, scrape, harvest or systematically extract data or content, except with our prior written consent (reputable search engines acting reasonably excepted);
- use bots or automated means that place an unreasonable load on the Service;
- interfere with the operation or security of the Service;
- impersonate any person or misrepresent your affiliation; or
- use the Service to send spam or unsolicited communications.
9. Intellectual property
The Service, and its design, text, graphics, logos and software, are owned by us or our licensors and are protected by law. Listing content remains the property of the respective auction houses or their licensors. We grant you a limited, personal, non-transferable licence to use the Service for its intended purpose. You may not reproduce, distribute or create derivative works from the Service except as expressly permitted or with our written consent.
10. Third-party sites and platforms
The Service links to third-party websites and bidding platforms (including BidSpirit) that we do not control. We are not responsible for their content, availability, terms or privacy practices. Your use of any third-party site or platform is at your own risk and is subject to that third party’s terms.
11. Communications and marketing
We send service messages relating to your account (such as email confirmation and, where you have opted in, reminders and alerts for auction houses and lots you follow). Marketing emails are sent only with your consent, and you can unsubscribe at any time using the link in any such email or from your account settings.
12. Privacy
We process personal data in accordance with our Privacy Policy and applicable UK data-protection law, including the UK GDPR and the Data Protection Act 2018.
13. Availability of the Service
We aim to keep the Service available but do not guarantee that it will be uninterrupted or error-free. We may change, suspend or withdraw all or part of the Service at any time.
14. Disclaimers
The Service and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly set out in these Terms, including as to accuracy, availability or fitness for a particular purpose.
15. Our liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under law.
Subject to that, we are not liable for: any auction, bid, sale, purchase, lot, payment, valuation or dispute involving an auction house or bidding platform; any loss arising from inaccurate, changed or withdrawn listing information; or any indirect or consequential loss, or loss of profit, revenue, data or opportunity.
If you are a consumer, these Terms do not affect your statutory rights, including under the Consumer Rights Act 2015. If you use the Service in the course of a business, our total liability to you arising out of or in connection with the Service is limited to £100.
16. Indemnity (business and auction-house users)
If you use the Service in the course of a business (including as an auction house), you agree to indemnify us against any claims, losses or costs arising from your breach of these Terms or from content you submit.
17. Suspension and termination
We may suspend or terminate your access to the Service, or remove content, if you breach these Terms or where we reasonably consider it necessary. You may stop using the Service and close your account at any time.
18. Changes to these Terms
We may update these Terms from time to time. The “last updated” date at the top shows when they were last changed. Continued use of the Service after a change takes effect means that you accept the updated Terms.
19. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
